Abstract(s)
A presente dissertação analisa o que pesa na decisão editorial quando os órgãos de
comunicação social se deparam com um caso que se encontra em segredo de justiça. Para
esse efeito escolhemos a Operação Marquês, pelas especificidades que este caso
apresenta, cujo protagonista central é um ex-primeiro-ministro.
Numa primeira fase foi importante perceber de que forma comunica a justiça e que
estratégias devem ser aplicadas para que os tribunais e os órgãos de informação não
permaneçam “de costas voltadas”, refletir sobre o fenómeno da corrupção, a liberdade de
imprensa e o segredo de justiça. Posteriormente definimos a conceção de interesse público
e de interesse do público e de que forma os jornalistas se posicionam perante o segredo
de justiça face ao interesse público da notícia.
A partir da análise de conteúdo qualitativa de peças publicadas nos jornais Expresso, Sol,
Correio da Manhã, Diário de Notícias e revista Sábado sobre o tema, no período
compreendido entre 2014 e 2015, e das entrevistas realizadas a jornalistas e editores dos
referidos jornais foi possível concluir que existe alguma elasticidade na definição do
conceito de interesse público e que se verificam vários atropelos à deontologia dos
jornalistas.
ABSTRACT: The present dissertation analyses what weighs on the editorial decision when the media is faced with a case that is under secrecy of justice. For that purpose we have chosen Operação Marquês, for the specificities it presents, whose main protagonist is a former Prime Minister. In the first phase, it was important to understand how justice communicates and which strategies should be applied so that the courts and the media do not remain "back to back", to reflect on the phenomenon of corruption, the freedom of the press and the secrecy of justice. Subsequently, we defined the concept of public interest and the interest of the public and how journalists position themselves before the secrecy of justice vis-à-vis the public interest of the news. From the qualitative content analysis of pieces published in the newspapers Expresso, Sol, Correio da Manhã, Diário de Notícias and Sábado magazine on the theme, in the period between 2014 and 2015, and the interviews conducted with journalists and editors it was possible to conclude that there is some elasticity in the definition of the concept of public interest and that there are several violations of the deontology of journalists
