Abstract(s)
Esta dissertação tem como tema o estudo do teatro, a sua prática e regulamentação legal em Portugal e em Cabo Verde. Quer o direito, quer o teatro, tocam problemas sociais. Com este trabalho procuramos compreender a situação do teatro do ponto de vista legislativo, ou seja, da regulamentação legal, visto que esta área do “fazer artístico” nem sempre merece a devida atenção. Particularmente em Cabo Verde, verifica-se que são recentes as iniciativas legislativas nesta matéria, apresentando-se o teatro como um setor carente da devida regulamentação a muitos níveis. Sendo o teatro um setor de atividade que congrega diversos artistas, a Covid-19 veio trazer um outro olhar sobre a condição laboral e social dos mesmos. Os direitos legais dos artistas em confinamento e com os espetáculos adiados foi um assunto que abriu telejornais, fez manchetes de primeira página e alimentou diversas reportagens na comunicação social, sendo matéria de vasta opinião nas redes sociais. Esta convulsão social propiciou um avanço nos direitos legais dos artistas, um outro olhar por parte dos Governos, embora a situação ideal ainda esteja longe de ser atingida.
ABSTRACT - This dissertation has as its theme the study of community theater, its practice and legal regulation in Portugal and Cape Verde. In both countries, the law and the theater touch on social problems. With this work, we seek to understand the situation of the theater from the legislative point of view, that is, from the legal regulation, since this area of “artistic making” does not always deserve due attention. Particularly in Cape Verde, it appears that the legislative initiatives in this matter are recent, presenting the theater as a sector in need of proper regulation at many levels. The Covid-19 has brought another look at the work and social condition of the artists. The legal rights of artists in confinement and with shows postponed was a subject that opened television news, made front-page headlines and fueled several reports in the media, being the subject of wide opinion on social networks. This social upheaval provided an advance in the legal rights of artists, another look by the Governments, although the ideal situation is still far from being achiev.
